TERMS AND CONDITIONS
PLEASE ENSURE YOU READ THE TERMS OF TRADE VERY CAREFULLY AS “EVERGREEN BRIDES” WILL REQUIRE YOU TO SIGN BY WAY OF YOUR AGREEMENT WITH THE FOLLOWING STATEMENTS:
Customers should retain their sales contracts, and any other receipts as proof of purchase and be sure to have read this TERMS AND CONDITIONS NOTICE and fully understand its requirements.
EVERGREEN BRIDES has such terms to protect its business regardless of your circumstances.
PAYMENT OF ORDER
a) Customers are required to pay a 50% NON-REFUNDABLE deposit on the date of ordering all bridal gowns, bridesmaids/prom dresses and accessories.
b) No Refunds will be given for any reason, even if the goods have not been ordered from the supplier.
c) All goods must be paid for in full upon collection/first fitting and before seamstress makes any changes.
ALL GOWNS REMAIN THE PROPERTY OF EVERGREEN BRIDES UNTIL PAID FOR IN FULL.
d) All items purchased are non-returnable/refundable.
SALE GOWNS & ACCESSORIES BOUGHT CANNOT BE RETURNED OR ANY PAYMENT ALREADY MADE REFUNDED. SOLD AS SEEN.
CANCELLATION OF ORDERS
a) Customers who cancel their sales contract are NOT entitled to a refund of ANY MONEY already paid up to and including the cancellation date.
Please be aware that once gowns are ordered minimum cancellation periods from suppliers apply to Evergreen Brides and under NO circumstances this can be changed.
b) Dress orders will still have to be paid for in full if the wedding is cancelled for whatever reason, costs will still be incurred to the suppliers and to Evergreen Brides – regardless of ANY circumstance.
c) For reasons of hygiene ALL accessories – (tiaras, hair slides, veils) – which have been removed from the premises once paid for cannot be refunded or exchanged.
a) Gowns are ordered in standard sizes or made to measure (depending on the supplier). Please be aware that gown sizes are different to that of high street sizes.
b) This contract is made on the understanding that Evergreen Brides will order your dress to the closest sizes using the suppliers sizing charts and accept no liability for their accuracy. Alterations may be required.
c) After the sales order contract has been signed and order placed, Evergreen Brides CANNOT AND WILL NOT accept any responsibility in respect of any changes which may occur in the Customers size and body shape.
d) It is not policy to take in gowns by any more than one dress size (maximum 2”) as this could adversely affect the style and look of the gown. It is at the customers risk if more than this is required to be taken in.
e) Gowns are designed to be worn with underwear, a suitably white or nude structured bra/lingerie is advisable but at the customers personal choice. A strapless bra is always best, even if you don’t want a strapless dress.
DELIVERY OF GOODS
a) Any dates of expected delivery of the goods from the manufacturers are approximate and we will not be liable for any delay in delivery however caused.
b) Customers can expect their first fitting to be in 10-16 weeks.
c) If we are unable to provide any of the goods or services our liability to you will be limited to the return of any money paid by you for those goods or services.
d) Before you take the goods from Evergreen Brides you must satisfy yourself as to the condition of the goods and immediately draw attention to one of our staff of any defects or discrepancies.
e) We will not be liable for any defects or discrepancies subsequently discovered after the goods have left Evergreen Brides premises.
f) We will not be liable to you for any consequential compensation whatsoever due to the supply of the goods or their use to you.
g) Customers are asked to settle any balance due by the date of the gown arriving in store, before alterations are carried out. A letter or phone call will be sent to inform the customer of the gown’s arrival in the boutique.
Balances MUST be settled BEFORE the date of the first fitting at the very latest.
No fittings will be carried out on gowns that are not fully paid for by the date required.
h) It is ESSENTIAL that customers bring their wedding shoes and any underwear being worn on the wedding / prom day to their fitting appointment.
i) The default time scale for Evergreen Brides to complete your order is 188 working days from the date of your order. If your special event is within the 188 working days, you accept Evergreen Brides will not be liable to 'time is of the essence' contract.
a) The price of garments does not include any costs of alterations.
b) Any alterations made to garments are made strictly between you and the person altering the garment. We have no liability at all for the results of the alterations.
NON-COLLECTION OF GOODS
Evergreen Brides reserve the right to sell (or dispose) of any goods that have not been paid in full within six months of the date of order, without any further notification and any money paid will not be refunded. Gowns may be put into the shop stock to be re-sold.
a) Evergreen Brides is not able to guarantee the colour matching of individual bridesmaids unless the order for all garments is placed all on the same order date. Colour matching is more difficult when garments are ordered at different dates. There will be a better chance that all the garments will match if cut from the same fabric roll.
b) Evergreen Brides is unable to guarantee fabric swatch matches with in store garments due to fabric changes. Swatches should be regarded as indication only.
This applies to all fabrics, laces, beading and any other trimmings or embellishments.
Evergreen Brides will NOT be liable for any breaches caused by circumstances outside Evergreen Brides control, including acts of war, riot, terrorism, malicious damage, fire, flood or storm.
THE TERMS AND CONDITIONS OUTLINED ABOVE DO NOT IN ANY WAY AFFECT THE CUSTOMERS STATUTORY RIGHTS.
